Abstract
:
Recently, some methods have been developed in the management of government facilities. Partnership contracts between the public and private sectors are one of the approaches used in the late twentieth century. But these approaches were not very important in Saudi laws until the Kingdom of Saudi Arabia’s vision and strategy were adopted. Unlike other countries, the Kingdom’s purpose in enacting a law governing such partnership was not to reduce the burden on the state’s public treasury. But it aimed to upgrade the services offered, enhance the role of the private sector, and benefit from the private sector’s technical and human potential. By using the analytical approach of the texts of the law issued by Royal Decree No. (M/63) dated 05/08/1442 H. and its executive regulations issued by the board of the National Center for Privatization, this research sheds light mainly on the regular procedures followed in preparing, offering, awarding, and implementing partnership contracts as per the Saudi privatization law. The second chapter clarifies the legal procedures and the authorities responsible for offering projects subject to the privatization law. However, before proceeding with this chapter, it was important to clarify in a preceding chapter the legal character of partnership contracts in the comparative laws and contractual techniques for partnership contracts. And I recommend to complete the preparation of contract forms.
