This research is titled: "Principles of jurisprudence rules affecting the contemporary jurisprudential issues related to women in the acts of worship and family provisions". The objective of this research: is to prove that the scholars are extracting the law of Islam based on sustainable and flexible rules to keep up with the needs of the time and to be updates. The field of this research is the Principles of jurisprudence. The method of research: inductive and deductive. First: Regarding the jurisprudence rule: Mentioning the meaning of the rule, documenting it from the Principles of jurisprudence books, and mentioning Origin of the dispute in it, the famous views, and the evidence of each view, some discussions, and the most likely statement. Second: describing the contemporary issue, then stating the ruling of the contemporary issue by referring to the scholars and researchers and the available statements of the jurisprudential councils and fatwa committees, Also, mentioning the evidence Briefly, without stating the most exquisits because it is not the purpose of the research, and then stating of the impact of the rule on the contemporary issue. The outline of the research: The introductory chapter: The vocabulary of the title, Chapter 1: The Principles of jurisprudence rules relating to the judgment, Chapter2: The Principles of jurisprudence rules relating to Agreed evidences .Chapter3: The Principles of jurisprudence rules relating to disputable evidence, Chapter4 : The Principles of jurisprudence rules relating the terminology,Chapter5 : The Principles of jurisprudence rules relating to the purposes of legality. The chapters contain a number of rules and contemporary jurisprudential issues related to women to indicate the effect of the rule in them. As for the results of the research: the ancient jurists left an enormous wealth that contributed to solving the problems of the modern era, as well as it shows the reasons for the disagreement of the jurists by linking the rules of jurisprudence to jurisprudential issues, but the issues of jurisprudence may be affected by more than Principles of jurisprudence rules, The Principles of jurisprudence rules are derived and extracted from the verses of the Quran and Hadiths and the words of the Arabs. In conclusion, the research recommends the following: researching The Principles of jurisprudence rules that affect jurisprudential issues in other chapters of fiqh, researching the purposes of legality rules that affect jurisprudential issues, as well as the concern to take care of the contemporary issues and study them doctrinal study applied. Also, writing the Principles of jurisprudence in the form of rules formulated in a concise manner. |
