In this paper I addressed some of the guarantees of the public employee through my examination of those guarantees under both the civil Service regulations of the Kingdom of Saudi Arabia issued by the Royal Decree No. (m/ 49) dated on 10/07/1397 AH and The Council of Ministers' Resolution No.( 951) and the system of discipline of employees dated on 27 \06/ 11/02/1391 AH ,issued by the Royal Decree No. m/7, as compared to the civil Service regulations of the federal Government of the United Arab Emirates No.( 21) of 2001, which was modified by the federal law No.( 16) of 2005 and the Federal law No.(2) of 2006 of the United Arab Emirates.
I divided this study into a number of topics , The introductory course entitled "What is the government employee and public administration in the Saudi and UAE system"
Turning to the second topic, which dealt with the first demand, the bases for the promotion of the public employee in the Saudi and Emirati regulations , the advantages and disadvantages of each criterion, since the promotion is either based on seniority or selection or integration of both of them, and it became clear to us that the Saudi legislator has adopted the way of promotion that mixes between seniority and selection i.e. according to specific rules, his approach was followed by the Emirati legislator and we found that the best way to promote the public employee is through a mixed method, so as to avoid the defects and criticisms that have been made of the method of promotion by seniority and selection.
The third topic dealt with the guarantees of the discipline of the public official, where we discussed the guarantees of the public employee in the stages of investigation and trial. We found that the protection of public officials from the imposition of disciplinary sanctions without right is one of the most important reasons that prompted the regulatory body to provide several guarantees in respect of the discipline of the public servant.
Therefore, it was not left to the legislator without protection, but provided him with the means to stop accusing him if that was the requirement, and it can be said that the system has surrounded the public employee here with a guarantee that the first guarantee of administrative grievan and the second guarantee is the judicial guarantees represented by the judicial appeal against the decision to impose the penalty either by appeal or cancellation in accordance with the conditions and conditions prescribed by law. |
