Abstract
:
This study Analysis the franchise contract, and even if it is unique in its characteristics and elements. However, it is still confused with other contracts that may be similar with it in some of the properties. Therefore, the lack of an independent system organizing the franchise business leads to study how efficient the systems of commercial agencies for organize the franchise contract in the kingdom. The study based on analytical method besides comparative approach in some aspects, the first chapter defines the franchise contract and the stages of its development, and it explores its types. The second chapter, I did a comparison between the franchise contract and the other similar contracts to recognize the difference between them. It explains the legal nature of the franchise contract, the impact of the validity and termination of the contract, obligations of both parties, and the confusion in the implementation of other contracts systems. The third chapter discussed the legal regulation of franchise at the kingdom and in comparison legal systems. It discusses the problem of the lack of franchise system in the kingdom as well as resulting from annexation the franchise contract under commercial agencies system. The study also includes a number of recommendations were presented in the conclusion.
